In 2014 the Essex Autonomy Project undertook a six month project, funded by the AHRC, to provide technical advice to the UK Ministry of Justice on the question of whether the Mental Capacity Act is compliant with the United Nations Convention on the Rights of Persons with Disabilities. Over the course of the project, the EAP research team organised a series of public policy roundtables, hosted by the Ministry of Justice, and which brought together leading experts to discuss and debate (...) the issues. This paper explores the value of the eros motif for critical pedagogy and citizenship education. The conceptual affinities between eros and democracy are identified and integrated into a theory of democratic political education. Long recognized as vital to the process of self knowledge, the ancient Greek concept of eros has nevertheless been largely erased from contemporary educational debate. By retrieving eros from the fringe of academic discourse and integrating it with critical pedagogy, the aims of radical democracy can be more (...) fully achieved. The essay emphasizes the civil society or cultural dimensions of democracy as against its legal or procedural aspects. Renewed emphasis on the associational qualities of democracy underscore the importance of eros as an educational principle. The ancient pedagogical motif of educating the desires is posited as an alternative to the liberal/modernist paradigm of education which de-values affective domains of knowledge. (shrink)

Background:Clinical investigation is a growing field employing increasing numbers of nurses. This has created a new specialty practice defined by aspects unique to nursing in a clinical research context: the objectives, setting, and nature of the nurse–participant relationship. The clinical research nurse role may give rise to feelings of ethical conflict between aspects of protocol implementation and the duty of patient advocacy, a primary nursing responsibility. Little is known about whether research nurses experience unique ethical challenges distinct from those experienced (...) by nurses in traditional patient-care settings.Research objectives:The purpose of the study was to describe the nature of ethical challenges experienced by clinical research nurses within the context of their practice.Research design:The study utilized a qualitative descriptive design with individual interviews.Participants and research context:Participating nurses self-identified as having experienced ethical challenges during screening. The majority were Caucasian, female, and worked in outpatient settings. Approximately 50% had > 10 years of research experience.Ethical considerations:The human subjects review board approved the study. Written informed consent was obtained.Findings:Predominant themes were revealed: the inability to provide a probable good, or/do no harm, and dual obligations. The following patterns and subthemes emerged: conflicted allegiances between protocol implementation, needs of the participant, desire to advance science, and tension between the nurse–patient therapeutic relationship versus the research relationship.Discussion:Participants described ethical challenges specific to the research role. The issues are central to the nurse–participant relationship, patient advocacy, the nurse’s role in implementing protocols, and/or advancing science.Conclusion:Ethical challenges related to the specialized role of clinical research nurses were identified. More research is warranted to fully understand their nature and frequency and to identify support systems for resolution. (shrink)

There couldn't be a more appropriate method for illustrating the dynamics of psychoanalysis than the vehicle of story. In this book, Kerry L. Malawista, Anne J. Adelman, and Catherine L. Anderson share amusing, poignant, and sometimes difficult stories from their personal and professional lives, inviting readers to explore the complex underpinnings of the psychoanalytic profession and its esoteric theories. SummarySon preference has been considered as a determinant of women's risk of intimate partner violence experience in India, although quantitative evidence from large nationally representative studies testing this relationship is limited. This study examines the association between husband's son preference, sex composition of children and risk of physical and sexual IPV victimization among wives. Information was collected for 26,284 couples in the nationally representative 2005–2006 National Family Health Survey of India. The exposures were husband's son preference measured as husband's desire (...) for one or more sons greater than the number of daughters and sex composition of the household: only sons, only daughters and mixed. Outcome included past year physical and/or sexual IPV. The results showed that husband's reported son preference and sex composition of children were not associated with risk for IPV victimization in the models adjusted for socio-demographic factors. The findings from this first population-based study of socio-cultural norms around son preference and married Indian women's risk for IPV victimization indicate that cultural preference for sons does not influence women's risk for IPV victimization. Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas and strategies toward building (...) a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. He had graduated from St Mary’s Seminary in Baltimore and was being ordained as a Roman Catholic priest. The event was attended by many of my family members. Several of the littlest attendees struggled with all the commotion, some were said to be shy, some didn’t want to be crowded, (...) and parents and caregivers did what they could to make it easier on them. Watching those kids trying to cope with a family event, which was different and a bit confusing, brought back a flood of memories of my own childhood. Nothing was simple about my childhood.My life has been “interesting” for sure. As a young child I faced many challenges. Until the age of two and a half I was nonverbal. Even though later I would gain speech, my developmental delays and sensory integration dysfunction issues caused great [End Page 202] difficulty for myself and my parents. I was evaluated by professionals and was diagnosed with an autism spectrum disorder–pervasive developmental disorder not otherwise specified (PDD–NOS) at the age of four.Thoughts of that difficult time filled my head when watching the children at this family function. My uncles, aunts and cousins couldn’t possibly know my struggles in those years. They weren’t present for all the interventions and therapy sessions I endured. Today, they don’t see me as someone different or disabled. I still have some obstacles to overcome in my development but rather than bemoan where I am or where I have been I have chosen to accept myself as I am. Although some may say I have a disability I choose to embrace my abilities and to celebrate them. I’m glad I’ve stayed on a path that has led me to become an independent adult. I am now a national motivational speaker, a Master’s graduate, owner of a non–profit corporation and soon to be an author.But what about this word “disabled”? Since I was six years old I seemed to have been tagged with this word by those around me. They all considered autism as a disability. I didn’t even know I had autism until I was 11. But I was very aware of people defining me as being disabled. It had to be the reason I was being placed in Special Ed classes, for the hours I had to travel to doctors and therapies: occupational therapy, physical therapy, speech therapy. I was being called disabled and I didn’t know why. Of course the signs were there for me that I had a problem. In daycare many things confused and frightened me: loud noises, wind, water, transitions. I cried constantly, a lot more than everyone else. I had terrible tantrums (lying on the floor kicking and screaming) to the confusion and consternation of the adults and caregivers around me. I attended two different daycare centers and was asked to leave both of them. I couldn’t even make the transition from the door of a daycare center to my parent’s car without fighting, screaming and crying uncontrollably.It’s now hard to believe that my difficulty with sensory integration dysfunction, transitions and social interactions lasted for almost 15 years of my life. During those years there were many confusing, frightening and painful episodes for me, my parents and others around us.Like most kids with these types of deficits, we tried to find splinter skills to help me compensate. I have hyper–mobility of the joints making buttoning and fine motor tasks almost impossible. I also have dysgraphia, which makes it difficult for me to hold a pen or pencil to write. Even with therapy I never learned to ride a bicycle. One bright side to the hyper–mobility was being able to learn to type 100 words per minute.My sensitivity to water, wind and loud sounds was extreme. I fought my parents each time they tried to get me into the bathtub. I hated going on the swings because I couldn’t feel my feet on the ground... (shrink)

I adapt Robert Sinnerbrink's notion of cinematic poesis by arguing that Terrence Malick's The Thin Red Line constitutes an example of ecological cinematic poesis: a style of filmmaking that works in concert with the limits and potentialities of the filmmaking as a medium. This cinematic bearing emerges in a new way following Malick's return to Hollywood, where a combination of factors spur the emergence of a radical Emersonian practice of cinematic receptivity. I draw on oral histories, and the film itself, (...) to demonstrate how Malick's creative process consistently tends towards an ethos of poverty. To further pattern and illuminate the ecological stakes of this Emersonian stance, I draw on the complementary framework of second-order systems theory, and in particular, on Niklas Luhmann's concept of simultaneity. In so doing, I outline the layered nature of Malick's cinematic praxis – a doubled Emersonian receptivity which not only invites defamiliarizing depictions of warfare and the nonhuman, but also welcomes, and toys with, the otherness haunting technical images and human cognition. As such, The Thin Red Line, and its immediate counterparts, perform the ecological work of reframing the conditions of wonder, asking us to marvel not at what we have seen, but what we haven’t. T. R. V. Murti is a Tamil Brahmin. He was born at Madras in 1902, and educated at Trichinopoly Christian College, which he left before graduating to commence five years of Congress Party work. He was in jail five months. In 1925 he came to Benares, where he studied the Sanskrit classics with pandits and gurus. He then completed his undergraduate course at Benares Hindu University, receiving his A.B. and M.A. together in 1929. From 1929 to 1936 he was a (...) fellow at the Indian Institute of Philosophy at Amalner. Here he came under the influence of Professor K. C. Bhattacharya, and was considered to be, among the philosophers at Amalner, the one who best understood the Professor's teaching. In 1936 he returned to Benares Hindu University for advanced study, and later was appointed Sayaji Rao Gaekwad Professor of Indian Civilization and Culture. He has been there since, except for three years on leave as professor of philosophy at Colombo and one year as Spalding Professor of Oriental Religions at Oxford. (shrink)

But you’ll also find essays that examine the diet from the perspective of contemporary environmental philosophy, feminist philosophy, critical race theory, philosophy of science, and pragmatism (to mention just a few of the philosophical approaches employed). Some of the essays use Atkins to illuminate philosophy, others use philosophy to illuminate Atkins, and some do a little of both. All of the essays invite you to think—more carefully, perhaps, than you usually do—about why you eat what you choose to eat. They’re not here to tell you what to think—or what to eat, for that matter. But that doesn’t mean they aren’t going to give you plenty of ideas to digest—at least some of which might leave you feeling bit queasy. Ghanshamdas Rattanmal Malkani, a Sindhi Kshatriya, was born in 1892 at Hyderabad Sind, and educated at Karachi, where his principal philosophy teacher was T. L. Vaswami. When the Indian Institute of Philosophy was founded in 1916, he was one of the six original fellows chosen to attend it. He soon became its permanent director and, except for two years at Cambridge University, has been there ever since. Since 1926 he has also been editor of the Philosophical Quarterly, which under him (...) has become India's leading philosophical journal. (shrink)

Aldo Leopold was a pragmatist in the vernacular sense of the word. Bryan G. Norton claims that Leopold was also heavily influenced by American Pragmatism, a formal school of philosophy. As evidence, Norton offers Leopold's misquotation of a definition of right (as truth) by political economist, A.T. Hadley, who was an admirer of the philosophy of William James. A search of Leopold's digitised literary remains reveals no other evidence that Leopold was directly influenced by any actual American Pragmatist or by (...) Pragmatism (although he may have been indirectly influenced by Pragmatism early in his career). A 1923 reference, by Leopold, to Hadley and Hadley's putative definition of truth, cited by Norton, is dripping with irony. Leopold, as he matured philosophically, regarded a profound cultural shift from anthropocentric dominionism and consumerism to an evolutionary-ecological worldview and an associated non-anthropocentric 'land ethic' to be necessary for successful and sustainable conservation. Hadley espoused a brutal form of Social Darwinism and his philosophy, as expressed in the book of Hadley's that Norton cites, is politically reactionary, militaristic and unconcerned with conservation. Leopold's mature philosophy and Hadley's – far from consonant, as Norton claims – are diametrically opposed. (shrink)

This research compares and analyzes the verbal commentary of televised coverage of two women's and men's athletic events: the “final four” of the women's and men's 1989 National Collegiate Athletic Association basketball tournaments and the women's and men's singles, women's and men's doubles, and the mixed-doubles matches of the 1989 U.S. Open tennis tournament. Although we found less overtly sexist commentary than has been observed in past research, we did find two categories of difference: gender marking and a “hierarchy of (...) naming” by gender and, to a certain extent, by race. These differences are described and analyzed in light of feminist analyses of gendered language. It is concluded that televised sports commentary contributes to the construction of gender and racial hierarchies by marking women's sports and women athletes as “other,” by infantilizing women athletes, and by framing the accomplishments of women athletes ambivalently. While provisions of youth sports concussion laws are very similar, little is known as to how they are being implemented, factors that promote or impede implementation, or the level of compliance in each jurisdiction. We aimed to describe state experiences with implementation in order to inform ongoing efforts to reduce the harm of sports-related traumatic brain injury and to guide future evaluations of the laws’ impacts and the development of future public health laws. We conducted key-informant interviews in 35 states (...) with recently enacted concussion legislation. States varied considerably in their readiness and capacity for implementation. Factors facilitating implementation included existing partnerships, procedures, and resources; centralized implementation authority; prior related efforts; and involvement in the policymaking process by those now charged with implementation. Inhibitors included ambiguous statutory language, unclear delegation of authority, and compliance difficulties. Ongoing challenges persist, including primary prevention; determining which providers are qualified to make return-to-play assessments and contents of those assessments; compliance difficulties in rural and under-served areas; and unclear responsibility for enforcement. Despite the similarity of youth sports concussion laws, early evidence suggests there is considerable variation in their implementation. These findings are critical for ongoing empirical investigations to accurately evaluate the laws’ provisions and to identify successful legal approaches to protecting young athletes. (shrink)

Over the past decade, a flurry of media stories devoted to sports-related concussions have drawn attention to the previously “silent epidemic” of traumatic brain injury in athletes. From 2001 to 2009, the annual number of sports-related TBI emergency department visits in individuals age 19 and under climbed from 153,375 to 248,414, an increase of increase of 62 percent. Multiple head injuries place youth athletes at risk for serious health conditions, including cerebral swelling, brain herniation, and even death — postconcussive conditions (...) that have collectively been referred to as “second impact syndrome.” Studies have shown that children and teens — and girls, in particular — are more likely to sustain a concussion and have a longer recovery time than adults. Recent research also suggests that even subconcussive hits in children and adolescents may result in longer-term health effects such as decreased cognitive functioning, increased rates of depression, memory problems, and mild cognitive impairment. Certainly I am in no way opposed to philosophy, or metaphysics in the sense that Wm. James defined it as a particularly intense effort to think clearly. Indeed, Klein would like to say that what I am talking about is nothing but metaphysics. But the kind of philosophy/metaphysics that is needed here is of a particular kind: a kind that does not separate philosophy/metaphysics and physics into two disjoint realms. Artificial intelligence and robotics have increasingly been adopted in agri-food systems—from milking robots to self-driving tractors. New projects extend these technologies in an effort to automate skilled work that has previously been considered dependent on human expertise due to its complexity. In this paper, we draw on qualitative research carried out with farm managers on apple orchards and winegrape vineyards in Aotearoa New Zealand. We investigate how agricultural managers’ perceptions of future agricultural automation relates to their approach to expertise, or (...) the degree to which they think specialised skills and knowledge are required to perform agricultural work on their orchards and vineyards. Our research generates two insights: the perceived potential for work to be automated is related to the degree to which it is seen to require technical or embodied expertise, with technical expertise being more automatable; and, while embodied expertise is perceived to be more difficult to automate, it is sometimes attributed more exclusively to those in positions of power, such that embodied expertise can be highly valued while the majority of embodied work is viewed as non-expert and thus automatable. Our analysis illustrates that a robot can be an expert when expertise is technical. It also shows variability in the conceptualization of skilled or unskilled work, and that those conceptualizations can set the stage for the future effects of new technologies. This generates new insights into the conditions under which automation might reproduce existing inequalities in agriculture, and also raises new questions about responsibility in the context of automation. In June 2021, Missouri passed the “Second Amendment Preservation Act” (SAPA). Though SAPA passed easily and had gubernatorial support, many Missouri law enforcement agencies, including the Missouri Sheriff’s Association, oppose it. Missing from this policy conversation, and deserving of analysis, is the voice of Missouri citizens. Using qualitative interview data and survey data, we explored what if anything Missouri gun owners knew about SAPA and what they perceived its effects would be on gun-related murders, suicides, gun thefts, and mass shootings. (...) Most Missouri gun owners had not heard about SAPA and were ambivalent about its potential effect on gun safety outcomes. Our findings also indicate that respondents’ attitudes toward SAPA and the impact of such policy on safety is driven by gun ownership (i.e., primary versus living in a household with firearms), partisan identification, and attitudes toward government firearm regulation. The pull to coordinate with other individuals is fundamental, serving as the basis for our social connectedness to others. Discussed is a dynamical and ecological perspective to joint action, an approach that embeds the individual’s mind in a body and the body in a niche, a physical and social environment. Research on uninstructed coordination of simple incidental rhythmic movement, along with research on goal‐directed, embodied cooperation, is reviewed. Finally, recent research is discussed that extends the coordination and cooperation studies, examining (...) how synchronizing with another, and how emergent social units of perceiving and acting are reflected in people’s feelings of connection to others.
